Job Description
Job Description:
- The team member is responsible for ensuring accounts impacted by bankruptcy are handled in strict compliance with applicable laws and regulations. This role involves reviewing and processing bankruptcy notifications, and updates, received from approved vendors or mail, coding accounts as bankrupt in the appropriate system of record, and excluding them from collection activities to prevent violations of the automatic stay.
- The Associate researches and resolves match criteria exclusions, manages manual coding for exceptions, and monitors joint filings and community property cases. Additional duties include quality assurance reviews, maintaining accurate documentation, collaborating with attorneys and account holders, and supporting compliance through regular training and adherence to procedural controls.
- The position covers a range of consumer and small business products, including credit cards, lines of credit, and installment loans. Strong attention to detail, excellent Microsoft suite skills, ability to complete complex tasks with minimal oversight and critical thinking skills.
- Experienced paralegal responsible for legal research, preparation of legal documents, file management and other assigned or routine tasks. Works under direct supervision using established principles, practices and procedures. Ability to determine and use appropriate internal and external resources.
Role Responsibilities: - Proofs of Claim are legal documents submitted to bankruptcy courts to assert the bank’s claim for amounts owed. Filing must meet strict court deadlines (“Bar Dates”).
- Not all accounts require a POC. Automated and manual reviews ensure only eligible, compliant claims are filed (e.g., not out-of-statute, not low-value, not fees/interest only).
- Every POC undergoes multi-level review—first by the preparer, then by an approved designee, with checklists and system controls to ensure accuracy and compliance.
- Claims are filed electronically (ECF/PACER) or manually, depending on court requirements. Special handling is required for certain jurisdictions and product types.
- Claims can be amended or withdrawn for valid reasons (e.g., errors, payments, jurisdictional issues), but require management/designee approval.
